Dogs Must Be Under Proper Control at Lettie Spencer Playing Field
Lettie Spencer Playing Field is a valued community space that all residents should be able to enjoy safely. Following our February 2025 Council meeting, we want to clarify what "proper control" of dogs legally means to ensure everyone understands the requirements.
The playing field has been subject to byelaws since 1972, which states that dogs be kept under proper control and be effectively restrained from causing annoyance to any person.
Legal Definition of "Proper Control"
According to the Dangerous Dogs Act 1991 S.3(5) and as clarified in the case of Summers v London Borough of Richmond 2018, "proper control" has a specific legal meaning:
"Proper control means a dog being on a lead or muzzled if needed, or otherwise being at heel/close enough to the person in charge that it can be restrained if necessary or responding immediately to voice commands."
Guidelines for Dog Owners at Lettie Spencer Playing Field
When visiting the playing field with your dog:
1. Please keep your dog on a lead at all times
- This is the clearest way to meet the legal requirement for proper control
- It prevents unexpected interactions with other field users
- It gives you immediate control should any situation arise
2. Always ask permission before allowing your dog to approach other people or dogs, even when on a lead
The playing field is a multi-purpose space used by many different people, including children playing sports, families enjoying picnics, and those who may be uncomfortable around dogs.
Why This Matters
Keeping dogs on leads in the playing field:
